Push for Expanded Use of Interlock

A recent press release on Digital Journal indicates that there is a movement to increase the use of the interlock in Maryland to potential include all DUI cases.  Current law requires the use of an interlock for those convicted of a blood alcohol concentration (“BAC”) .15 or higher  if they opt to forego the 120 day suspension. Subsequent violations also require the use of interlock.

Some states have more expansive use of interlock reaching for offenders regardless of the BAC.  Some activists want Maryland to join that list. If implemented the cost and hassle of a DUI conviction would rise and potentially offer a more deterrent to Maryland drivers. On the other hand, it may burden folks who make an occasional error in judgment with a years worth of interlock costs and monthly re-calibrations.  Offenders would also have to worry about violating the rules of interlock such as:

– Disabling the device or otherwise tampering with it.

– Falling behind on payments to the interlock provider.

– Not providing a follow-up breath sample when instructed to do so.

– Failing to attend scheduled monitoring sessions.

– Providing a breath sample that registers a BAC of 0.025 or higher.
